1. Platform Overview
TALENSER is a technology-driven professional matchmaking and intelligence platform facilitating: Talent-Company matching, Founder-Co-Founder matching, AI-based assessments, mock tests, and interviews, Verification and compliance screening.
TALENSER acts strictly as a digital intermediary and: Is not an employer, Is not a recruitment agency, Is not a financial or investment advisor, Does not manage or transfer funds, Does not guarantee hiring, funding, or partnership outcomes.
All decisions are the sole responsibility of users.
2. User Categories
Users may register as: Talent, Company, Founder, Co-Founder, Expert Interviewer.
Each category has separate registration, verification, access permissions, and subscription plans.
Users may hold multiple roles with password-protected switching.
3. Eligibility
Users must:
- Be 18 years or older
- Have legal capacity to contract
- Provide accurate, complete, and truthful information
- Not be prohibited by law or listed under sanctions
TALENSER reserves the right to deny, suspend, or terminate accounts at its discretion.
4. Account Registration & Credential Accuracy
Users must provide:
- Identity documents (government-issued ID)
- Education credentials
- Experience proofs
- Company documents (for companies/founders)
- Pitch decks or self-recorded videos for Founders/Co-Founders
Submission of false or misleading information is a material breach and may result in: Immediate termination, No refund, Legal action.
5. Expert Interviewer Policy
Expert Interviewers are third-party partners or freelancers.
KYC includes:
- Identity verification
- Education verification (optional)
- Experience verification
- Employee ID and corporate proof
Responsibilities include:
- Conducting interviews
- Scheduling according to platform rules
- Maintaining confidentiality and professionalism
6. AI & Automated Evaluation Disclaimer
TALENSER uses AI to:
- Score mock tests and AI interviews
- Generate compatibility and role-fit metrics
- Produce risk and retention indicators
AI outputs are assistive tools only: Not legally binding, Do not guarantee hiring outcomes, Must be verified independently.
Users can request human review of significant automated decisions.
7. Platform Neutrality
TALENSER remains neutral between all user types.
TALENSER does not endorse, certify, or validate: User skills or credentials, Company financial or legal standing.
Users must conduct their own due diligence.
8. Prohibited Conduct
Users shall not:
- Create fake or duplicate accounts
- Upload forged documents or misrepresent credentials
- Use discriminatory criteria in hiring or matching
- Harass or threaten other users
- Attempt security breaches, scraping, or AI manipulation
- Circumvent subscription or payment systems
Violation may result in:
- Account suspension
- Termination
- Legal proceedings
9. Subscription & Billing
Certain features require paid subscription. Subscriptions may auto-renew.
Fees displayed before purchase, GST and other taxes apply. Refunds handled per Refund & Cancellation Policy.
10. User Content License
Users retain ownership of uploaded content.
By submitting content, users grant TALENSER a worldwide, royalty-free, non-exclusive license to:
- Store, process, and analyze
- Display for platform operation
- Use for AI model improvement (anonymized)
11. Limitation of Liability
Services are provided "as-is" and "as-available".
TALENSER is not responsible for:
- Failed hiring
- Business losses or missed opportunities
- AI-based decision outcomes
Maximum liability: subscription fees paid in the last 3 months.
12. Indemnification
Users agree to indemnify and hold TALENSER harmless against claims arising from:
- Policy violations
- Fraudulent credentials
- Misuse of platform
- Legal breaches
13. Force Majeure
TALENSER is not liable for delays or failures caused by:
- Natural disasters
- Cyberattacks
- Government actions
- Infrastructure disruptions
- Labor disputes
14. Assignment
TALENSER may assign or transfer rights freely. Users cannot assign rights without written consent.
15. Severability
Invalid or unenforceable provisions do not affect the remainder of the agreement.
16. Entire Agreement
This ToS and referenced policies constitute the full agreement between user and TALENSER.
17. Electronic Consent
Users consent to receive communications electronically. Checking the consent box or using the platform constitutes legally binding agreement.
18. Export Control & Sanctions
Users must comply with Indian and international laws regarding export controls and sanctions. Access from prohibited jurisdictions is blocked.
19. Termination
TALENSER may suspend or terminate access for:
- Policy violations
- Fraud detection
- Abuse of refunds or subscriptions
- Failed verification
20. Governing Law & Arbitration
Governed by the laws of India. Disputes resolved via Arbitration under Arbitration and Conciliation Act, 1996. Seat of arbitration: Hyderabad, Telangana. Courts of Hyderabad have exclusive jurisdiction.
